WHEREAS, Section 7-144 of the Illinois Pension Code specifies that a retirement annuity shall be suspended when an annuitant again becomes an employee in a position which normally requires at least 600 hours per year, and

WHEREAS, Section 7-154 of the Code provides that the widow of an annuitant shall be entitled to a widow annuity under certain conditions, and

WHEREAS, Section 7-164(1) of the Code provides for a single sum death benefit upon the death of an employee with at least one year’s service, now therefore, be it

RESOLVED, that an annuitant who has returned to work as a participating employee shall be considered to have the status of both an annuitant and an employee, and be it further

RESOLVED, that the widow of such a person shall be eligible for the following optional benefits:

  1. A widow annuity based on her husband’s suspended retirement annuity, plus a single sum death benefit computed under Section 7-164(1) of the Illinois Pension code, or
  2. (2) A widow annuity based on her husband’s suspended retirement annuity, plus a supplemental widow annuity provided by the credits he accumulated subsequent to the granting of the suspended retirement annuity.
